What’s in a Home Information Pack?

The home information Pack contains important information that the buyer and sellers need to know, anyone marketing a property, or their representative, will be legally required to have Home information Pack.

For Sellers providing a pack up front should reduce the likely hood of any nasty suprises in the selling process as buyers will be able to make an informed decision about purchasing their home.

For Buyers, the pack provides essential information about properties they are considering buying.

 

Do You Need A Pack?

Yes if you have a property which came on the market after 14th Decemeber 2007.

You do not need a Home Information Pack for:


  • Properties where there is no marketing (e.g. sale to a member of your family)
  • Non – residential properties
  • Seasonal and holiday accommodation
  • Mixed sales (e.g. Shop with flat)
  • Right to buy
  • Sales of portfolios of properties
  • Properties not being sold with completely vacant possession
  • Unsafe properties and properties to be demolished

 

What does a pack contain?

Home Information Index

The index is a compulsory item of the Home Information Pack and provides a check list for Sellers Buyers, estate agents and enforcement authorities.
Where a document that must be included in the Pack is unavailable, the index must say so, give the reason it is missing, and indicate what steps are being taken to obtain it.

Energy Performance Certificate

Energy Performance Certificate tells you how energy efficient a home is on a scale of A-G. The most efficient homes – which should have lowest fuel bills are in band A.
The certificate also tells you, on a scale of A-G, about the impact the home has on the environment.
The certificate includes recommendations on ways to improve the homes energy efficiency to save you money and help the environment.

Sellers of newly built homes will have to provide a predicted assessment of the energy efficiency of the property, but a full Energy Performance Certificate should be provided to the buyer when the home is completed.

Sale Statement
The Sale Statement should provide some basic information:

  • The address of the property being sold
  • Whether the property is Freehold, Leasehold or commonhold
  • Whether the property is registered or unregistered
  • Whether or not the property is being sold with vacant possession.

 

Evidence of Title
These documents prove that the seller owns the property and therefore has the right to sell. Where the property is being sold is registered document that must be included are:

  • Official copies of the individual register
  • An official copy of the Title Plan

In the case of commonhold interest, official copies of the register and title plan should be produced for both unit and common parts.
For sales of unregistered land the pack must include a certificate of an official search of the index map, and those documents that the seller intends to rely on to provide evidence of the title of property.

Standard Searches

  • Local Land Charges Register
  • Other record held by the local authority on matters of interest to the buyers, such as planning decisions and road building proposals.
  • The provision of drainage and water services to the property.

These items are optional and can be added at the seller’s discretion.

Legal Summary
Summary of legal content

Home Use/Contents Form
Information on a range of matters ie; boundaries, Services and Planning. As well as a fixtures and fitting form.

Other Documents
Non Standard Searches, guarantees and warranties.
